| Class Action Waivers in Arbitration Agreements Sometimes Unenforceable |

The California Supreme Court has ruled that class action waivers in arbitration agreements will not be enforced in cases where class arbitration would be a significantly more effective way to vindicate employee rights than would individual arbitration. Class action is generally more effective if the dispute involves a small amount of damages and a large number of potential claimants. See Gentry v. Superior Court (2007) 42 Cal.4th 443.
