| Bill Seeks to Overturn Supreme Court Decision in Ledbetter v. Goodyear Tire |

In response to the U.S. Supreme Court decision in Ledbetter v. Goodyear Tire, a bipartisan group of senators has introduced a bill which would allow for recovery of back pay for discrimination suits filed under Title VII has been introduced. The bill is aimed at overturning a US Supreme Court decision which limited the scope of pay discrimination claims by holding that the actionable claim arose at the time that the negative performance evaluations were determined and not when the paychecks were issued. The Court rejected the plaintiff’s argument that she was subjected to gender discrimination each time she received a paycheck which paid her less than her male counterparts. Instead, the court held that a discrimination claim is not extended even though the effects of the discrimination may be felt much later. See Ledbetter v. Goodyear Tire & Rubber Co. (2007) 127 S.
