| California Supreme Court to Review Decision Increasing Class Action Liability |
The California Supreme Court will review an appellate decision which held that representative claims for unpaid wages brought under the Unfair Competition Law must be brought as class actions, but that claims for penalties under the Private Attorney General Act do not. The appellate ruling could well have resulted in an increased number of wage and hour lawsuits seeking penalties on behalf of all injured employees under the PAGA. See Arias v. Superior Court (2007) 153 Cal.App.4th 777
