Meal and Rest Payments are Wages
According to the California Supreme Court, the additional hour of pay required by Labor Code Section 226 for meal or rest period violations is a wage, rather than a penalty.  Consequently, claims for unpaid meal and rest pay will be subject to a three-year statute of limitations and failure to pay can give rise to waiting time penalties.  See Murphy v. Kenneth Cole Productions, Inc. (2007) 40 Cal.4th 1094.
