Administrative Exemption Reviewed by Court
A California Court of Appeal decision provides some new guidance on the administrative exemption.  The plaintiff was employed to sell, install, and train clients on specialized payroll software.  The court determined that the plaintiff was not exempt.  The decision primarily turned on the fact that plaintiff did not spend more than 50% of his time performing work directly related to management policies or general business operations.  As a result, plaintiff was entitled to $46,617.00 in back pay overtime, plus interest and attorney’s fees.  See Eicher v.
