Two Courts Issue Temporary Injunctions: Employers Need Not Post Notice of Union Rights—Stay Tuned

On Friday a federal court in South Carolina issued a temporary injunction blocking the NLRB rule requiring employers to post information informing employees of their rights under the National Labor Relations Act.  This morning, a federal court in Washington D.C. issued a second temporary injunction blocking the implementation of the rule. 

The NLRB rule requires an employer to post the notice of organizing rights by April 30, 2012.  These injunctions have placed the posting date in question. 

Employers are advised to remain abreast of developments in this area.  We will continue to monitor actions in the courts and will pass along rulings as they are made.
