An amendment to section 1510 of the California Labor Code, provides clarification to existing law requiring private employers to permit employees to take paid leaves of absence for organ and bone marrow donation. Employers with 15 or more employees must provide for 30 days of paid leave in a one-year period for organ donation; and 5 days of paid leave in a one-year period for bone marrow donation. This amendment clarifies that the one-year period is a rolling 12-month period measured forward from the date an employee uses the leave. The leave entitlement is to be measured in business days, not calendar days. The leave is not considered a break in service for purposes of benefit accruals and seniority. Finally, an employer may require an employee taking bone marrow leave to use up to five days of accrued paid time off, and an employee taking organ donation leave to use up to two weeks of accrued paid time off.
